Property Titles in Saint-Martin: What the New Agence Foncière Means for Buyers

Saint-Martin now has a public office whose only job is fixing land titles. The Agence foncière de Saint-Martin opened in Marigot on May 4, 2026 and helps families who have occupied land for 30 years or more without a notarized deed to obtain one, free of charge. For anyone planning to buy property in Saint-Martin, it is a useful reminder of the first thing we check on every French-side file: who actually holds title, and can they sell.

What the Agence foncière is

The agency is a public interest group (GIP) co-financed by the French State and the Collectivité de Saint-Martin. Prefect Cyrille Le Vély and President Louis Mussington inaugurated it on June 26, and the local press has been reminding residents this month that the service is free.

  • Who runs it: director Gaëtan Grach, with a small team that includes a jurist.

  • Where: 2 rue du Général de Gaulle, Marigot. Forms are available in French, English and Spanish, at the agency, the Préfecture and the Collectivité.

  • Who it helps: residents who have occupied a plot for at least 30 years without a notarized title.

  • Where it starts: Sandy Ground, Quartier d'Orléans and Rambaud are the priority neighborhoods.

  • What it cannot do: process land in the 50 pas géométriques, the coastal strip. It can study those cases and refer them to the Collectivité's commission.

About 30 files came in during the first months.

Why the numbers matter

A 2024 study found that roughly one family in three on the French side lives on land without a notarized title. The agency's director puts it more sharply for the market: nearly 60% of available or buildable land is held in indivision, blocked, or without title. Land in that state cannot be sold, formally rented or insured. The rebuilding after Irma in 2017 made the problem more visible, because reconstruction and insurance claims both run into missing paperwork.

For the property market, this means a large share of the land that could be built on today cannot legally change hands. As titles are regularized, some of it will come to market. We expect that to happen slowly, file by file, not as a wave. Over several years, though, more plots in neighborhoods like Sandy Ground and Quartier d'Orléans should become sellable and, eventually, financeable.

What to check before you buy property in Saint-Martin

Most villas and condos we sell in Terres Basses, Orient Bay, Anse Marcel or Baie Nettlé come with a clean title and a long notarial history. The risk sits mainly with bare land, older family houses and private sales. Before signing a compromis de vente, we go through this list:

  1. The seller's title. Ask for a copy of the deed in the seller's own name. If the answer is "it is family land", find out who the heirs are before going further.

  2. Indivision. When a property is held jointly by several heirs, all of them must agree to the sale. One missing signature can freeze it for years.

  3. The coastal strip. Near the shore, confirm whether the plot falls within the 50 pas géométriques. Regularizations there are decided by the Collectivité's Executive Council, not through an ordinary sale.

  4. Cadastre and boundaries. Check the parcel reference and surface, and use a surveyor (géomètre) if the boundaries on the ground do not match the plan.

  5. Conditions in the compromis. Make title and planning checks conditions of the sale, so the deposit comes back if they fail. The notaire verifies the chain of ownership before the acte authentique; give them the time to do it.

Our view is simple. We would not sign a compromis on land where the seller cannot produce a notarized deed in their own name, however good the price looks. A plot with a title problem is not a bargain. It is a project, and it runs on the agency's timeline, not yours.

The Dutch side works differently

On the Dutch side, a civil-law notary checks title and liens against the Land Registry (Kadaster) before the transfer. The question there is usually not whether a title exists but what kind it is: freehold or long lease (erfpacht). Different system, same principle: the paperwork decides what you are really buying. If you are selling family land

If you own land on the French side without a notarized title, the agency is the right first step, and it costs nothing. A buyer's notaire will not close without a clear title, so regularizing first is what makes a sale possible at all. When the paperwork is in order, we can talk about valuation and timing.

Questions we get

Can I use the Agence foncière as a buyer? No. It helps long-term occupants obtain a title. As a buyer, your protection is the notaire's title search and the conditions written into the compromis.

Is land without a title cheaper? It may be priced lower, but until it is regularized you cannot receive a deed, and a bank will want a clean title before lending. The discount rarely covers the time and risk.

How long does a regularization take? There is no published timeline. The agency opened in May 2026, and each file depends on the documents and the family situation. Do not sign anything that assumes a date.

Does this affect villas in Terres Basses or Orient Bay? The agency's priority areas are Sandy Ground, Quartier d'Orléans and Rambaud. Established estates generally have a long notarial record, but the notaire checks every file, and so do we.
